Louisiana's UCC Resources

LOUISIANA’S UCC RESOURCES

The Uniform Commercial Code (UCC) has been adopted in all fifty (50) states (in addition to some U.S. territories and foreign countries), however each state’s statutes may be comprised of their own variation of the UCC.  Louisiana was the last state to adopt the UCC and has adopted all but three of the UCC Articles. 

The first two UCC Articles that have not been adopted by Louisiana, specifically UCC Article 2 and 2A, contain the rules regarding Sales and Equipment Leases.  Louisiana’s Sales law can be found in Louisiana Civil Code Articles 2438 to 2659 and Louisiana Revised Statutes 9:2901, et seq.  Louisiana’s Lease law can be found in Louisiana Civil Code Articles 2668 to 2800 and the Louisiana Lease of Movables Act is located in Louisiana Revised Statutes 9:3301, et seq.  

The third article not adopted by Louisiana is UCC Article 6, which provides the rules on Bulk Transfers.  At the current time, Louisiana does not have a specific Bulk Sales law[1]. 

The UCC, as adopted by Louisiana, can be found in Title 10 of the Louisiana Revised Statutes. The main sections are as follows:

[1] The Bulk Sales Act was repealed in Louisiana in 1991, effective as of January 1, 1992.
